According to the DVSA (VOSA) guideline book ‘Guide to Maintaining Roadworthiness’: 1.‘Drivers are responsible for the condition of their vehicles when in use on the road and must, therefore, be able to report any defects or symptoms of defects that could prevent the safe operation of vehicles.’ 2. ‘A daily walk-round check should be undertaken by a responsible person before a vehicle is first used; this is usually carried out by the driver’ 3. ‘Failure to take this responsibility seriously could result in the driver losing their entitlement to driver and/or in more serious circumstances result in Manslaughter charges being brought against them’ It has also to be stressed that a light vehicle daily walk-round check is as much a part of a company’s routine maintenance as operating a lorry/truck. As such, operating such vehicles in a unroadworthy condition, would almost certainly impact on an owners operator licence. There is a declaration within this which is to ensure vehicles are maintained to a roadworthy standard includes ensuring drivers carry out daily walk around checks of their vehicles. The check should at least cover the external condition, ensuring in particular that the lights, tyres, wheel fixings, bodywork, trailer coupling (if applicable), load and that any ancillary equipment is serviceable. Drivers must be able to report any defects that could prevent the safe operation of the vehicles. Drivers may be prosecuted for the existence of defects found on the vehicles they drive if they are considered partly of wholly responsible for the existence of them, however the operator’s responsibility, under section 6 of the DVSA’s (VOSA’s) Guide to Maintaining Roadworthiness, to have a system in place to quality monitor these checks.
